Language of Instruction

The language of the educational process is the state language — Ukrainian.

On January 16, 2021, Article 30 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” entered into force.
The main legislative requirements regarding the state language in educational institutions: Article 30 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” applies to the field of education.
Educational institutions are legal entities that provide educational services, meaning a set of actions defined by legislation, an educational program and/or an agreement, which have a determined cost and are aimed at enabling the learner to achieve the expected learning outcomes (Clause 18, Part 1, Article 1 of the Law of Ukraine “On Education”).

THE LANGUAGE OF THE EDUCATIONAL PROCESS IN EDUCATIONAL INSTITUTIONS IS THE STATE LANGUAGE
In accordance with Article 7 of the Law of Ukraine “On Education”, the language of the educational process in educational institutions is the state language. The State guarantees every citizen of Ukraine the right to receive formal education at all levels (preschool, general secondary, vocational (vocational-technical), professional pre-higher and higher education), as well as extracurricular and postgraduate education in the state language in state and municipal educational institutions.
Persons belonging to national minorities of Ukraine and indigenous peoples are guaranteed the right to receive preschool and primary education in municipal educational institutions in the language of the respective national minority or indigenous people, alongside the state language.

ALL EMPLOYEES OF AN EDUCATIONAL INSTITUTION MUST BE PROFICIENT IN THE STATE LANGUAGE
Officials and employees of enterprises, institutions and organizations of state and municipal ownership — namely heads of educational institutions, employees of education management bodies, pedagogical, academic and research staff — except for foreigners or stateless persons invited to educational institutions and/or scientific institutions who work temporarily as academic, pedagogical, research and teaching staff or foreign language teachers, are required to be proficient in the state language and use it in the performance of their official duties (Article 9 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”).

THE STATE LANGUAGE IS THE WORKING LANGUAGE OF COMMUNICATION IN EDUCATIONAL INSTITUTIONS
Furthermore, pursuant to Part 1 of Article 12 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”, the state language is the working language of communication in enterprises, institutions and organizations of state and municipal ownership, including meetings, events and official gatherings.
The state language must be used during working hours by academic, pedagogical and other employees of educational institutions.
The state language must be used within the educational process during classes (except for subjects which, in accordance with the educational program of the institution, are taught in foreign languages or in the languages of indigenous peoples and national minorities), in communication between teachers, lecturers and other staff of educational institutions both with learners (students) and among themselves (Letters of the Ministry of Education and Science of Ukraine No. 1-9-581 dated September 17, 2019 “On the Use of the State Language in the Educational Process” and No. 1/9-74 dated February 1, 2018 “On the Use of the Ukrainian Language in the Educational Sphere”).

THE STATE LANGUAGE IN THE FIELD OF PROVIDING EDUCATIONAL SERVICES
While the above requirements primarily concern state and municipal educational institutions, Article 30 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” establishes that all business entities must serve consumers in the state language.
In the field of education, this applies to educational institutions, enterprises, institutions and organizations of all forms of ownership, as well as individual entrepreneurs providing educational services.
Thus, education of any level and form — full-time, part-time, distance, network-based, external, family (home-based), etc. — as well as the provision of educational services, professional training, online education, education via television/radio, and correspondence education must be conducted in the state language.
By Order of the Cabinet of Ministers of Ukraine dated July 8, 2020 No. 852-r, Taras Dmytrovych Kremen was appointed as the Commissioner for the Protection of the State Language.
The Commissioner for the Protection of the State Language is an official whose status, powers and procedure for their implementation are defined in Chapter VIII “Protection of the State Language” (Articles 49–57) of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”.
